The 78rpm Collectors' Community is a social networking and blogging platform for collectors of 78 rpm records, music, gramophones, phonographs and record cutting machines. Please do not create an account if you are not interested in this subject.

The following terms and conditions govern all use of the 78rpm Collectors' Community website and all content, services and products available at or through this website.

This website is only available to individuals who are at least 13 years old.

1. Your 78rpm Collectors' Community Account
If you create an account on the 78rpm Collectors' Community, you are responsible for maintaining the security of your account, and you are fully responsible for all activities that occur under your account.

2. Responsibility of Contributors
If you operate an account and post material (links, audio, blog posts, videos, etc) on our website, you are entirely responsible for the content of, and any harm resulting from that content. That is the case regardless of whether the content in question constitutes text, graphics, an audio file, or computer software. By making content available, you represent and warrant that:

* the downloading, copying and use of the content does not infringe the proprietary rights of others;
* the content does not contain or install any viruses, worms, malware, trojans or other harmful or destructive content;
* the content is not spam or machine- or randomly-generated or misleads recipients as to the source of the material (such as spoofing);
* the content is not pornographic, illegal, libellous or defamatory;
and by submitting user-created content to 78rpm Collectors' Community for inclusion, you grant the 78rpm Collectors' Community a world-wide, royalty-free, and non-exclusive license to reproduce, modify, adapt and publish the content solely for the purpose of displaying, distributing and promoting. If you delete content, the 78rpm Collectors' Community will use reasonable efforts to remove it from our website, but you acknowledge that caching or references to the content may not be made immediately unavailable.

3. Responsibility of Visitors
The 78rpm Collectors' Community has not reviewed, and cannot review, all of the material posted to our website, and cannot therefore be responsible for its use or effects. The 78rpm Collectors' Community does not represent or imply that it endorses the material posted on its site, or that it believes such material to be accurate, useful or non-harmful. You are responsible for taking precautions as necessary to protect yourself and your computer systems from harmful or destructive content.

4. Copyright Infringement
The 78rpm Collectors' Community asks others to respect intellectual property rights and the intellectual property rights of others. If you believe that material located on or linked to by the 78rpm Collectors' Community violates copyright, you are encouraged to notify the 78rpm Collectors' Community for action by using the contact link at the bottom of this page.

The 78rpm Collectors' Community will respond to all such notices as required by removing the infringing material or disabling all links to the infringing material if it is proven by the owner that such material is under copyright. In the case of a visitor who may infringe or repeatedly infringe the copyright or intellectual property rights of the 78rpm Collectors' Community or others, the 78rpm Collectors' Community may, in its discretion, terminate or deny access to the website.

5. Changes
The 78rpm Collectors' Community reserves the right, at its sole discretion, to modify or replace any part of this agreement. It is the users responsibility to check this agreement periodically for changes. The 78rpm Collectors' Community may also, in the future, offer new services and/or features through our website (including, the release of new tools and resources). Such new features and/or services shall be subject to the terms and conditions of this agreement.

6. Termination of Accounts
The 78rpm Collectors' Community reserves the right to terminate access to all or any part of our website at any time, with or without cause, with or without notice, effective immediately.

7. Cultural Sensitivities
The goal of the 78rpm Collectors' Community is to foster learning, study and understanding of the multi-faceted history of 78rpm recording and record techniques in an educational and factual way by means of first-hand experiences. Hobbyists, collectors and professionals who worked in the recording industry are active members of our community and offer factual accounts, stories and knowledge as part of this websites, user-submitted content. We try to present to the widest audience possible early commercial sound recordings for educational research, comment, review and information, offering a broad range of historical and cultural documents (such as discographies) as a contribution to education and lifelong learning.

These selections are presented as part of the record of the past. They are historical documents which reflect the attitudes, perspectives, and beliefs of different times. The 78rpm Collectors' Community does not endorse the views expressed in these recordings, which may contain content offensive to users.

8. About Advertisements and Other Commercial Content
Our goal is to deliver an advertising platform and the associated ads generated by that platform that are not only valuable to advertisers, but also valuable to you. In order to do that, you agree to the following when you advertise with us or create ads for distribution on our network: You can use your privacy settings to limit how your name and profile picture may be associated with commercial, sponsored, or related content (such as a brand you like) served or enhanced by us. You give us permission to use your name and profile picture in connection with that content, subject to the limits you place. We do not give your content or information to advertisers without your consent. You understand that we may not always identify paid services and communications as such.

9. Special Provisions Applicable to Advertisers
You can target your specific audience by buying ads on 78rpm Collectors' Community. The following additional terms apply to you if you place an order through our online advertising portal ("Order"): When you place an Order, you will tell us the type of advertising you want to buy, the amount you want to spend, and your bid. If we accept your Order, we will deliver your ads as inventory becomes available. When serving your ad, we do our best to deliver the ads to the audience you specify, although we cannot guarantee in every instance that your ad will reach its intended target. In instances where we believe doing so will enhance the effectiveness of your advertising campaign, we may broaden the targeting criteria you specify. You will pay for your Orders as you go - so you control payments. Your ads will comply with our Community Guidelines. We will determine the size, placement, and positioning of your ads. We do not guarantee the activity that your ads will receive, such as the number of clicks you will get. We cannot control how people interact with your ads, and are not responsible for click fraud or other improper actions that affect the cost of running ads. We do, however, have systems to detect and filter certain suspicious activity. Our license to run your ad will end when we have completed your Order. You understand, however, that if users have interacted with your ad, your ad may remain until the users delete it. We can use your ads and related content and information for marketing or promotional purposes. You will not issue any press release or make public statements about your relationship with 78rpm Collectors' Community without written permission. We may reject or remove any ad for any reason. If you are placing ads on someone else's behalf, we need to make sure you have permission to place those ads, including the following: You warrant that you have the legal authority to bind the advertiser to this Statement. You agree that if the advertiser you represent violates this Statement, we may hold you responsible for that violation.

10. Your Content
The content you upload to our site is yours. You own the copyright to it as long as it is not copyrighted to someone else (and if that is the case, you should be aware of our policy regarding copyright. Please see item No.4 above). Even though you own your content and have copyright to it, by agreeing with our terms of service, you grant the 78rpm Collectors' Community access to your content to display on our site. You also grant us the right to reproduce your content in other forms (such as a podcast or a webpage article or for use in our printed or downloadable newsletter/magazine document) as long as we, 1) - make no profit from it and 2) - acknowledge you as the author/creator.

11. Closing of User Accounts
When you wish to no longer be a member of our community, you need to send us an email/P.M. letting us know of your wish to close your account. We will then "retire" your account - which effectively makes your profile and profile details inaccessible to you, the administrator of the site and to other members. The content you have uploaded however, (such as photos, videos, posts and music) will continue to be displayed and made available to users and visitors of the site. We are currently unable to "delete" user accounts and your associated uploaded content completely.

12. Our 78rpm Record Cataloger - Software
You are free to use our free, 78rpm record cataloging software (available for PC and Mac OSX) here: (http://www.78rpmcommunity.com/beta/pages/software).

1) By downloading this software, you agree not to distribute it via any means - including third party websites, torrents, forums, cloud storage, CD, DVD or other storage device.
2) By downloading our software, you agree to accept all liability of its use on your computer system(s) and indemnify us for any failure of the software or systems using our software.

1) If you download our software from our website, we guarantee that it is the most, up-to-date version and that it is virus and trojan free.
